These Terms & Conditions (“Terms”) govern your access to and use of hellobeautifulbrand.com (the “Site”) and the purchase of any products offered by The Hello Beautiful Brand (“we,” “us,” or “our”). By accessing our Site or purchasing our products, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Site.

1. Eligibility & Use of the Site

By using this Site, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement under applicable law.

You agree not to use the Site for any unlawful or prohibited purpose, including attempting to interfere with the Site’s security or functionality.

2. Products & Intended Use

Our products are cosmetic and personal care products intended for external use only.

• Products are not intended to diagnose, treat, cure, or prevent any medical condition.

• Results may vary by individual.

• Always review ingredient lists and discontinue use if irritation occurs. 

• "Due to the natural and anhydrous nature of our formulations, products may be sensitive to temperature changes during transit. Melting, softening, or texture variations (such as graininess) are natural characteristics of botanical butters and do not compromise the product's efficacy. The Hello Beautiful Brand is not responsible for products that melt during transit or after delivery, and such items are not eligible for refunds or replacements."

"We utilize natural, botanical oils, and nut butters in our formulations. It is the sole responsibility of the consumer to review all ingredient lists prior to purchase and use. We strictly recommend performing a 24-hour patch test on a small area of skin before full application. If any irritation or reaction occurs, discontinue use immediately. The Hello Beautiful Brand LLC is not liable for individual adverse skin reactions or allergic responses."

3. Orders, Pricing & Payments

All prices are listed in U.S. dollars and are subject to change without notice.

We reserve the right to:

• Refuse or cancel any order at our discretion

• Correct pricing or description errors

• Limit quantities per customer or order

Payment must be received in full before orders are processed and shipped.

4. Shipping

Shipping times are estimates and not guaranteed. Delays may occur due to carrier issues, weather, or supply chain disruptions beyond our control.

We are not responsible for lost or stolen packages once marked as delivered by the carrier.

5. Returns & Refunds

We want you to feel confident in your purchase.

Due to the hygienic nature of body care products, the following applies:

• Returns are accepted only for unopened, unused products within 14 days of delivery.

• If seal is broken, opened or used, products are non-returnable.

• Sale items, gift sets, and promotional items will be final sale unless otherwise stated

• Return Shipping: The customer is solely responsible for all return shipping costs. We highly recommend using a trackable shipping service, as we cannot guarantee that we will receive your returned item. Original shipping fees are strictly non-refundable.

• Damaged or Defective Items: If your product arrives damaged or leaking due to transit, you must report the issue to us at Cassandraparker@hellobeautifulbrand.com within 48 hours of the delivery timestamp. Your email must include your order number and clear photographic evidence of the damage. Approved damage claims will be eligible for a replacement or store credit.Refunds for eligible returns are issued to the original payment method once the return is received, inspected, and approved by our team. This policy complies with applicable U.S. consumer protection laws.

6. Subscription Orders (If Applicable)

Subscription discounts apply only to eligible items and recurring orders.

• You may cancel or modify your subscription before the next billing cycle.

• Discounts cannot be retroactively applied.

• Subscriptions are subject to availability and price changes with notice.

7. Intellectual Property

• Ownership of Content: All content on this Site—including product names, descriptions, images, logos, branding, text, graphics, and the overall presentation—is owned by The Hello Beautiful Brand LLC or used with permission and is protected by applicable U.S. and international copyright, trademark, and intellectual property laws. • Proprietary Methodologies & Frameworks: All proprietary skincare methodologies, specific routine sequences, named skin systems, educational marketing frameworks, and product application protocols developed by us (including, but not limited to, the core steps of exfoliation, reinforcement, and sealing) are the exclusive intellectual property of The Hello Beautiful Brand LLC. Unauthorized copying, imitation, or commercial use of these unique conceptual frameworks and instructional systems is strictly prohibited.

• Trade Dress & Brand Identity: Certain brand elements, including the specific look, feel, color schemes, and design of our product packaging, containers, and website layout, are protected under applicable U.S. unfair competition and trade dress laws. Competitors are legally prohibited from mimicking these elements to cause consumer confusion.

8. User Content & Reviews

By submitting reviews, testimonials, or other content, you grant us a royalty-free, perpetual, worldwide license to use, display, and share such content for marketing and promotional purposes.

We reserve the right to remove content that is misleading, offensive, or violates these Terms.

9. Disclaimer of Warranties

All products and services are provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

Some states do not allow limitations on implied warranties, so portions of this section may not apply to you.

10. Limitation of Liability

To the fullest extent permitted by law:

• Our total liability for any claim shall not exceed the amount paid for the specific product, giving rise to the claim.

• We are not liable for indirect, incidental, consequential, or punitive damages.

This limitation applies whether the claim is based in contract, tort, negligence, or otherwise.

14. Governing Law & Jurisdiction

These Terms and any disputes arising hereunder are governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict of law principles. Subject to the mandatory arbitration provisions in Section 15, any permitted legal actions or proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Tennessee, and you hereby consent to the personal jurisdiction of such courts.

15. Mandatory Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

• Mandatory Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, the breach thereof, or the use of the Site or purchase of products shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall take place in the State of Tennessee, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

• Waiver of Court Proceedings: By agreeing to these Terms, both you and The Hello Beautiful Brand LLC mutually agree to waive any right to pursue disputes in court, including the right to a jury trial, except for small claims court matters that qualify or requests for temporary injunctive relief to protect intellectual property rights.

• Class Action Waiver: You and The Hello Beautiful Brand LLC agree that any arbitration or legal proceeding shall be conducted solely on an individual basis. You explicitly waive any right to initiate, join, or participate as a plaintiff or class member in any class, collective, consolidated, or representative action or lawsuit against us.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Site.
